VETERAN’S DISABILITY BENEFITS
Veteran’s disability benefits, especially service-connected benefits, may help you receive Social Security benefits. For example, if you are a Veteran who qualifies for 100% service-connected disability benefits, then the SSA should expedite your SSD application. This gives you a better chance of a quick decision from the SSA.
Also, SSA’s rules state they must take into account any disability rating from the VA. Additionally, if you get SSDI benefits, then you can also get Medicare benefits. Medicare benefits are a form of health insurance to cover medical costs. Find out about Medicare benefits.
Dianna Cannon is certified by the Veterans Administration to represent Veterans. She can represent veterans in their claims for service connected veteran disability benefits. SOCIAL SECURITY AND VETERAN’S DISABILITY BENEFITS
If the Veterans Administration finds you eligible for service connected compensation, you may also win Social Security Disability benefits. You are eligible for both benefits if you have service-connected VA benefits. VA benefits range from $133 to $3,068 per month. The amount of your monthly payments depends on your VA disability rating.
In order to be eligible for Veteran’s disability benefits and Social Security benefits, you must have “service connected” VA benefits. If you receive “non-service connected” VA disability benefits, SSD benefits will be offset from VA benefits. In other words, you cannot receive the full amount of the two benefits. Instead, the lower benefit subtracts from the higher benefit.
MENTAL CONDITIONS AND SSD BENEFITS
Many Veterans cannot work due to their mental condition. For instance, some veterans have Post Traumatic Stress Disorder (PTSD) and Depression. Other veterans may suffer from Anxiety and anger management issues. Other mental conditions include Schizophrenia, Traumatic Brain Injury, or Personality Disorder. All of these mental issues can keep you from working.
The number of PTSD cases has nearly tripled in the last 10 years. For example, in 2008 there were 345,000 cases. In 2018, there were more than 940,000 cases. Service-connected PTSD benefits now make up 22 percent of all compensation cases in the Veterans Administration. If you are a Veteran who already has service connected benefits, then the SSA may also find you qualify for SSD benefits. This, however, is not automatic.
The SSA system is very different from the VA rating system. The VA rating system gives ratings for specific injuries and medical conditions. SSA’s system, however, is an all or nothing system. If you cannot work, then you are eligible for benefits. When SSA awards benefits they do so with the understanding that you will never work again. In the VA system, however, you can have a disability rating and still work. Despite these differences, you should still apply for both benefits.
PHYSICAL IMPAIRMENTS AND VETERAN’S BENEFITS
If you are a Veteran, then your medical condition may be due to physical injuries from service. For example, you may have a back injury or leg or arm injuries. Additionally, you might have hearing loss or loss of a limb. In 2001, the rate of service connected disability increased despite a decrease in the size of the veteran population. This increase coincides with the United States entering into the wars in Afghanistan and Iraq. Since October 2001, the U.S. deployed over 1.64 million U.S. troops in Operations Enduring Freedom and Iraqi Freedom.
Because of the advances in military medicine, more service members survive their wounds. The most recent Department of Defense Casualty Update shows over 52,000 service members were wounded in action in Afghanistan and Iraq.
According to the study, Invisible Wounds of War, thousands of service members have been diagnosed with “invisible wounds” once they returned home. These numbers show that many Veterans have severe medical conditions. Therefore, you may not be able to work. These benefits replace your income because you cannot work.
WILL SOCIAL SECURITY EXPEDITE YOUR CASE IF YOU ARE A VETERAN?
If you are a Veteran who is 100% service connected for disability benefits, then the SSA will expedite your SSD application. The SSA calls this expedited review. This means your SSD case should move through the review process more quickly.
In order to help veterans, the SSA should evaluate your case shortly after you apply. After you file for benefits, the SSA will need to review your medical records. Find out about the importance of medical records in your SSD case. Submitting medical records quickly will improve the application wait time.
The VA will usually give you your medical records for free. If you have medical records at different military bases, then collect all of them. This includes your physical records and mental health records. Make sure to ask for all of your records. Because mental health records can be kept in different location than the records about your physical health.
HOW CAN YOU APPLY FOR SERVICE-CONNECTED DISABILITY BENEFITS?
If you think you qualify for service connected VA benefits, then you can apply for benefits by filling out VA Form 21-526EZ.
This form is the APPLICATION FOR DISABILITY COMPENSATION AND RELATED COMPENSATION BENEFITS. If you have any of the following materials, then attach it to your application:
- Discharge or separation papers (DD214)
- Dependency records (marriage & birth certificates)
- Medical evidence (doctor & hospital reports)
You can also apply online at www.ebenefits.va.gov. Please remember that when you apply for service connected disability benefits, your disability must have started when you were in service. If the VA cannot connect your injury or medical condition to your time in service, then you will not receive service connected VA benefits.
